Terms

Terms of business

The terms on which we arrange flights for you.

Draft pending legal review. These terms were prepared to match how this business actually works, but they have not been settled by a lawyer qualified in [JURISDICTION]. Have them reviewed before you trade on them, and delete this notice once you do.

1. Who these terms bind

These terms govern every flight arranged by [REGISTERED COMPANY NAME], trading as SkyCourtage, for you as client. They apply from the moment you accept a quotation, and they prevail over any purchase conditions of your own unless we have agreed otherwise in writing.

2. Our role, and its limit

We act as a broker and intermediary. We are not an air carrier and we operate no aircraft.

For charter, we arrange a contract of carriage between you and a certificated air operator. That operator is the air carrier, is responsible for the operation and the safety of the flight, and its own conditions of carriage apply to you. For scheduled cabins, the airline is the carrier and its conditions and fare rules apply.

We are responsible for exercising reasonable care and skill in selecting and recommending operators, for the accuracy of what we tell you, and for administering your booking. We are not responsible for the performance of the flight itself.

3. Quotations

A quotation is indicative until issued in writing, and is valid only for the period stated on it. Availability and price in this market move hourly; a quotation that has expired may be re-priced.

Every quotation shows one final price, our margin included; we charge no booking fee. It also names the operator and aircraft type for charter, or the carrier and fare basis for scheduled cabins.

Unless stated, a quotation excludes: government taxes and fees introduced after issue, de-icing, waiting time beyond the allowance shown, additional handling, catering beyond the standard specified, ground transport, overflight or landing permits obtained at short notice, and costs arising from a change you request.

4. Booking and payment

A booking is confirmed when we have your written acceptance and cleared funds in accordance with the payment terms on the quotation. Unless agreed otherwise, charter is payable in full before departure and scheduled tickets are payable at ticketing.

We accept payment only to the account named on our invoice. We will never notify you of a change of bank details by email alone. If you receive such a message, telephone us on the number you already hold before sending anything.

5. Changes and cancellation by you

Changes are subject to the operator’s or airline’s agreement and may carry a cost, which we will put to you before acting.

Cancellation charges are those of the operator or airline that holds the booking, and are set out on your quotation. They typically rise as departure approaches and can reach the full price within the final days. Many negotiated scheduled fares are non-refundable from ticketing. Our margin, included in that price, is earned on confirmation and is not refundable, save where the cancellation results from our own failure.

6. Changes and cancellation by the operator

An operator or airline may change an aircraft, a schedule or a crew, and a commander may refuse or curtail a flight on safety grounds. That decision is final and we will not seek to influence it. Where that happens we will work to find an alternative at the earliest opportunity, and any refund follows the terms of the carrier holding the booking.

7. Passengers, documents and baggage

You are responsible for the accuracy of passenger names and details, and for holding valid passports, visas, permits and health documentation for every point on the itinerary. We will flag what we know of, but the obligation is yours and a refused boarding on documents is not refundable.

Baggage, sporting equipment, instruments, firearms, animals and anything requiring a permit must be declared at the time of quotation. Undeclared items may be refused at the aircraft.

8. Delay, disruption and force majeure

Neither we nor the carrier is liable for events beyond reasonable control, including weather, air traffic control restriction, airport or airspace closure, strike, technical failure, security incident, epidemic, or an act of a public authority. Statutory passenger rights against an airline, where they apply to your journey, are unaffected by this clause.

9. Liability

Nothing in these terms excludes liability for death or personal injury caused by our negligence, for fraud, or for anything that cannot lawfully be excluded.

Subject to that, our liability to you for any booking is limited to the margin we earned on it, and we are not liable for loss of profit, loss of opportunity, or consequential loss. Claims relating to the carriage itself lie against the carrier, under the conventions and conditions applicable to that carriage.

10. Complaints

Write to info@skycourtage.vip. We acknowledge within [X] working days and aim to answer substantively within [X]. Where the matter concerns the conduct of a flight we will put it to the carrier and stay with it until it is resolved.

11. Data

What we collect and why is set out in our privacy notice. To arrange a flight we must pass passenger details to operators, airlines, handling agents and authorities, which is a necessary part of performing your booking.

12. Governing law

These terms are governed by the law of [JURISDICTION], and the courts of [JURISDICTION] have exclusive jurisdiction, without prejudice to any mandatory protection available to you as a consumer in your country of residence.
